Walmart Responds to Tracy Morgan Truck Accident Claim

As the Tracy Morgan truck accident claim progresses, Walmart’s response suggests plaintiff injuries and damages may be a result of improper seatbelt use. The fatal truck accident occurred in June on the New Jersey turnpike when a Walmart truck driver rear-ended Morgan’s limo bus, leaving one dead and several others injured.

Following the accident, evidence revealed that truck driver Kevin Roper, the Walmart employee driving the supply truck, had violated safety regulations by operating his vehicle after going without sleep for more than 24 hours.

Morgan’s lawsuit against Walmart cited negligence and carelessness on behalf of the company for not complying with Federal Motor Carrier Safety Administration Regulations that protect motorists from the dangers of truck driver fatigue by mandating specific shift requirements and limitations.

Walmart has responded to Morgan’s claim and is now requesting a trial by jury, expressing a belief that the injuries caused in the truck accident were actually a result of improper seatbelt use on behalf of the plaintiffs.

As per the ongoing National Transportation Safety Board investigation, Walmart refrained from directly addressing claims regarding Roper, but the 28-page legal response did note that neither the company nor its employees should be held liable for damages which may have been caused entirely or partly by third parties.
